Members of group five agreed that the tribunal is needed to sanction nations, companies and individuals that pollute the environment and provoke climate change. All nations would be able to access the court and initiate cases irrespective of whether they have been affected already by climate change. The International Environmental and Climate Tribunal will be composed of representatives from nations and indigenous groups world wide who agree to respect international jurisdiction and legal norms. Members of group five has urged sweeping reforms of the United Nations so as to recognize and prioritize judgements by the new International Environmental and Climate Tribunal. The final clauses of group five’s document endorse Bolivia as the host nation for the tribunal and provide for the formation of a commission to establish the tribunal’s membership and charter.
